SUPPLEMENTAL - HOLDING OVER
(1)
HOLDING OVER. In the event Lessee shall hold over beyond the expiration of
the term herein provided or any renewal or extension thereof, it is
expressly understood and agreed that any such hold-over tenancy shall be a
month-to-month tenancy only, and either lessor or Lessee may terminate such
tenancy at any time by giving the other party at least twenty (20) days'
written notice of its intention to do so.

HOLD OVER
If Tenant shall remain in possession of the Premises after expiration of the
original or any extended term hereof, tenant's occupancy shall be a
month-to-month tenancy at the rental rate applicable to the last month of
the unexpired term and under all of the other terms,, conditions and
provisions hereof except those pertaining to the term of the Lease.
(3)
No holding over by Tenant after the expiration of the term of this lease or
any extension or renewal thereof, now the acceptance by Landlord of any rent
for any period of time subsequent to such expiration date, shall operate as
an extension or renewal of this lease, but on the contrary any such holding
over shall constitute a mere tenancy at will which either party may
terminate at any time.
(4)
HOLDING OVER.
Tenant shall pay to Landlord an amount as rent equal to 200% of one-twelfth
of the Base Rent and 200% of one-twelfth of the additional rent paid by
tenant during the previous Calendar Year herein provided during each month
or portion thereof for which tenant shall retain possession of the Premises
or any part thereof after the termination of the term or of tenant's right
of possession, whether by lapse of time or otherwise, and also shall pay
all damages sustained by landlord, whether direct or consequential, on
account thereof. At the option of Landlord, expressed in a written notice
to tenant and not otherwise, such holding over shall constitute a renewal
of this Lease for a period of one year at such Base Rent and additional Rent
as would be applicable for such year., and for purposes of determining the
additional Rent for any renewal period the original Base Year shall remain
as the base Year. The provisions of this paragraph shall not be deemed to
limit or constitute a waiver of any other rights or remedies of Landlord
provided herein or at law.
(5)
HOLDING OVER
In the event of holding over by Tenant after expiration or termination of
this lease without the written consent of Landlord, tenant shall pay as
liquidated damages double rent for the entire holdover period. No holding
over by tenant after the term of this lease shall be construed to extend the
lease; in the event of any unauthorized holding over. Tenant shall
indemnify Landlord against all claims for damages by any other Tenant to
whom Landlord may have leased all or any part of the premises covered hereby
effective upon the termination of this lease. Any holding over with the
consent of landlord in writing shall thereafter constitute this lease a
lease from month to month.
(6)
HOLD OVER
If Tenant occupies the Demised Premises after the expiration of the initial
term of this Lease without having exercised the option set forth above, or
if Tenant occupies the Demised Premises after the expiration of the
extension period, such occupancy shall be subject to all provisions of this
Lease and may be terminated by either party upon thirty (30) days prior
written notice to the other party.
