HOLDING OVER
(1)
Holding Over: In the event of any holding over beyond the end of the Term or
any extension thereof, this Lease shall be deemed a monthly tenancy upon
the covenants and conditions herein contained and upon the same monthly
rental as provided herein.
(2)
Holdover: It is further covenanted and agreed that if the Lessee, any
assignee or sublessee shall continue to occupy the leased premises after
the termination of this Lease without prior written consent of the Lessor,
such tenancy shall be Tenancy at Sufferance. Acceptance by the Lessor
of rent after such termination shall not constitute a renewal of this Lease or
a consent to such occupancy nor shall it waive Lessor's right of reentry or
any other right contained herein.
(3)
Holdover: At the termination of the term of this lease or any renewal
period thereof, by lapse of time or otherwise, Lessee will yield up immediate
possession of the premises to Lessor, in good condition and repair, loss by
fire and ordinary wear and tear excepted, and will return the keys thereof to
Lessor at the place of payment of rent. If Lessee retains possession of the
premises or any part thereof after the termination of the term by lapse of
time, a month-to-month tenancy shall be deemed to have been created,
upon the same terms of this lease. The provisions of this paragraph shall
not constitute a waiver by Lessor of any right of re-entry as hereinafter set
forth; nor shall receipt of any rent or any other act in apparent affirmance of
tenancy operate as a waiver of the right to terminate this lease for a breach
of any of the covenants herein.
(4)
Holding Over: In the event the Lessee remains in possession of the lease
term, or any extension thereof, this lease shall be automatically extended
on a month to month basis, subject to thirty (30) days termination by either
party, and otherwise on terms and conditions equivalent to the final month
of the lease term.
(5)
Hold-Over: It is agreed, however, without in any manner impairing the
covenants of the Lessee or the remedies of the Lessor, that should the
Lessee hold over in possession after the expiration of the original term or
of any extended term, such holding over shall not be deemed to extend the
term or renew the lease, but thenceforth a month-to-month tenancy shall be
thereby created upon the same covenants and conditions as are herein set
forth at the monthly rate of rental in effect during the first month of the
previous term until terminated at the end of any rental month by either
party by serving upon the other not less than thirty (30) days' previous
notice in writing of such termination.
(6)
Holding Over: If Lessee remains in possession of the Premises or any part
thereof after the expiration of the term hereof with the express written
consent of Lessor, such occupancy shall be a tenancy from month to
month at a rental in the amount of the last monthly rental plus all other
charges payable hereunder, and upon the terms hereof applicable to
month-to-month tenancy.
(7)
Holding Over: Any holding over after the expiration of the term of this Lease
Agreement with the consent of the Lessor, shall be construed to be a
tenancy from month to month, at the rental as herein specified, and shall
otherwise be on the terms and conditions herein specified so far as
applicable. This provision shall not be construed as giving Lessee any
right so to hold over.
(8)
Any holding over by Lessee after the expiration or other termination of this
Lease shall be deemed to be a tenancy from month to month only,
notwithstanding any law, ordinance, or custom to the contrary.
(9)
Holding Over: If the Lessee remains in the Premises beyond the expiration
of this lease, or as it may be extended, such holding over in itself shall not
constitute a renewal or extension of this lease, but in such event a tenancy
from month to month on all the terms and conditions set forth in this lease
except as to duration shall arise.
(10)
Holding Over: Should Lessee, or any of its successors in interest, hold over
the premises or any part thereof after the expiration of the lease term, unless
otherwise agreed to in writing by Lessor, such holding over shall constitute
and be construed as a month-to-month tenancy, and rental for such tenancy
will be paid at a rental equal to twice the per-day rental provided herein.
Lessee shall indemnify Lessor against all claims for damages by any other
tenant to whom Lessor may have leased all or any part of the Lease
Premises covered hereby, effective upon the termination of this Lease as
set out herein.
(11)
Holding Over: In the event of Lessee holding over after the termination of
this Lease, the tenancy shall be from month to month at a rent equal to
the last monthly rent paid to Lessor in the absence of a written agreement
to the contrary signed by both parties,
(12)
ARTICLE - HOLD-OVER
If Lessee shall remain in possession of the Property, or any portion thereof,
after expiration of this Agreement and Lease, Lessee shall be deemed a
Lessee from month to month at the same monthly rental and in all other
respects subject to the terms, covenants and conditions of this Agreement
and Lease. Such tenancy from month to month may be terminated by
either party giving - days written notice to the other.
(13)
If the Lessee shall remain in possession of the Premises and Property or
any part thereof after the expiration of the term hereof, the Lessee shall be
deemed a Lessee from month to month but not otherwise, at the rental of
per month, and in other respects-subject to all the terms, covenants and
conditions hereof,, and such tenancy from month to month may be
terminated by either party at the end of any month by giving written notice
to the other party at least prior to the terminating date.
(14)
Holding Over. Any holding over by Lessee of the Leased Premises after the
expiration of this Lease shall operate and be construed to be a tenancy from
month to month only, at the same monthly rate of rent and other charges
payable hereunder for the Lease term, or upon the mutual agreement of
Lessor and Lessee, and not otherwise, such holding over shall constitute a
renewal of this Lease for one (1) year at the same rental and upon all of the
other covenants and agreements contained in this Lease. If Lessee
continues to hold over after a written demand by Lessor for possession at
the expiration of the Lease or after termination by either party of a
month-to-month tenancy created pursuant to this Section; or after
termination of the Lease or of Lessee's right to possession pursuant to
Section hereof, Lessee shall pay monthly rental at a rate equal to double
the rate of rent payable hereunder immediately prior to the expiration or
other termination of the Lease or Lessee's right to possession. Nothing
contained in this Section hereof shall be construed to give Lessee the right
to hold over at any time and Lessor may exercise any and all remedies at
law or in equity to recover possession of the Leased Premises. Lessee
further agrees that any obligation it incurs for payment under this Section
will not be judged to have been satisfied by payment of the cancellation fee
due Lessor under the provisions of Section (Option to Cancel).
